Legal Agreement

The various websites (or "sites") of Christ In Youth, Inc. (hereafter "us" and derivatives thereof, "CIY" or "Christ In Youth") and the properties thereof are provided to you (hereafter "you" and derivatives thereof or "User") as a service subject to the Terms & Conditions set forth below, which may be updated by us from time to time without notice to you (hereafter "Terms & Conditions"). In addition, when using any particular Christ In Youth's owned or operated services, you shall be subject to any posted guidelines or rules applicable to such services, which may be posted from time to time. All such guidelines or rules (including, but not limited to CIY's Privacy Policy and Refund Policy) are hereby incorporated by reference into the Terms & Conditions. CIY may also offer other services that are governed by different terms and conditions. Your use of any CIY website is conditioned on your acceptance of and compliance with the Terms & Conditions. Your use of our any CIY website constitutes your acceptance of the Terms and Conditions and constitutes a binding, legal agreement between you and CIY. If you disagree with any of the Terms & Conditions, including the Privacy Policy and/or Refund Policy you should not use this or any CIY website. "Your use of any CIY website is conditioned on your acceptance of and compliance with the Terms & Conditions. Your use of our any CIY website constitutes your acceptance of the Terms and Conditions and constitutes a binding, legal agreement between you and CIY. If you disagree with any of the Terms & Conditions, including the Privacy Policy and/or Refund Policy you should not use this or any CIY website.

Intellectual Property

Christ In Youth is the owner and intellectual property holder of many "works" on its various websites that may be trademarked or protected by US copyright law. Any unauthorized use of any logo, image, content or other protected item from any CIY website is prohibited. Whether marked as such or not, CIY claims the copyright on any content, logo, or image on any of its sites that are not owned by a third party and may legally qualify for copyright or trademark protection.

External Links

In some cases CIY websites may include links to websites or documents owned by other persons or entities. CIY cannot control the content of or use of third-party sites or content. CIY is not in any way responsible for content on or the management of any third-party website. Users of CIY's websites are advised to use caution in determining when it is appropriate to use third-party links that may exist on a CIY website. Further, the existence of a link to another person or entity's website from a CIY website does not indicate an endorsement of that third-party site or any of the content or views that maybe contained therein.

Disclaimers

CIY websites are provided as a service on an as-is basis. CIY will not be responsible (financially or otherwise) for any errors, disruptions, or failures of the site. CIY will make reasonable efforts to maintain its sites in good working order, to minimize maintenance related down times, and avoid other disruptions.

Limitation of Liability

CIY will make reasonable effort to maintain the material found on its various websites current and accurate. If User feels that inaccurate information negatively impacted a purchase or donation decision CIY will take commercially reasonable efforts to correct the situation in a manner that is agreeable to both the User and CIY. HOWEVER, IF NO MUTUALLY AGREEABLE SOLUTION CAN BE FOUND, USER'S MAXIMUM REMEDY IS THE RETURN OF FUNDS RELATED TO THE PURCHASE OR DONATION. CIY SHALL BEAR NO FURTHER LIABILITY – FINANCIAL OR OTHERWISE – RELATED TO INFORMATION CONTAINED ON ANY OF ITS WEBSITES. YOU EXPRESSLY UNDERSTAND AND AGREE THAT CIY SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL CONSEQUENTIAL OR EXEMPLARY DAMAGES WHICH MAY BE INCURRED BY YOU, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY.

Indemnification

User agrees to indemnify, defend, and hold harmless Christ In Youth and its directors, officers, employees, agents, and assigns from and against any claim including reasonable attorney's fees arising out of or in any manner connected with User's activity on any CIY website. This provision applies to both the actions of the User and any violation on the part of the User of any provision of this Terms & Conditions policy.

Severability

If any provision of this policy or any of the policies incorporated herein are declared by a court of competent jurisdiction invalid, unenforceable, or illegal the remaining provisions herein shall remain in full force as though the invalid, unenforceable or illegal provision(s) had never existed.

Changes

CIY reserves the right to update and amend this Terms & Conditions policy from time to time as it sees fit with no requirement to notify users. Your continued use of the site will serve as your consent and agreement to the Terms & Conditions as they exist at any given time. CIY will post on its websites notice of material changes to this Terms & Conditions policy.

Refund Policy

In order to meet Internal Revenue Service requirements for tax deductibility, funds donated to Christ In Youth are considered non-refundable. If, however, one of the following apply, funds donated can be returned to you at your discretion:

  1. Funds were donated in error – If you inadvertently donated to Christ In Youth please contact us immediately at donate@ciy.com to void the transaction. If you do not contact us within 24 hours of the transaction occurring CIY cannot return the funds to you.
  2. CIY is unable to fulfill the basis of the donation – If you are donating to a particular initiative and we are unable to execute that initiative we will contact you to discuss whether your funds (at your discretion) can be applied to another ministry initiative or if you prefer those funds will be returned to you.

In any refund situation, CIY will return funds in the method they were given – credit card, check, etc. – unless the time elapsed from a credit card transaction does not allow the funds to be returned to the card. In that instance a company check will be sent to the address you request.

Privacy Policy

The security of your information is important and will be handled accordingly by Christ In Youth. The following represents our privacy policy as it pertains to online transactions.

Informational Gathered

Some of the uses of CIY's websites require certain personally identifiable information to be gathered. This information may include but is not limited to your name, email address, address, phone number, credit card information (if making a purchase or donation), etc. CIY will use SSL encryption when collecting financial information (credit card number, expiration date, etc.).

Informational Use

CIY will use your information to fulfill the purpose for which it was submitted – making a purchase or a donation, signing up for an event, etc. – and may use it to contact you about related activities. We will seek your permission before using it in any other manner. CIY will make use of opt-in and/or opt-out boxes when seeking permission to use your information for something other than the purpose it was submitted for or activities related to that purpose. CIY will not sell / give / lend or otherwise disclose to third-parties your information without seeking your permission other than in the manners listed below related to third-parties working on behalf of CIY or legal actions requiring disclosure of information.

Third Parties

In some instances, third-parties working on behalf of CIY may have access to your information specifically if their function is in fulfillment of the purpose for which you provided your information to CIY or if their function for CIY is in the maintenance of its various websites and/or data management. CIY, in establishing contractual relationships with various third-parties, will establish confidentiality requirements that the third-party is to be bound by.

Cookies

The function of certain aspects of some of CIY's websites require the use of Cookies – small data files sent to your computer that track your browsing history. You may be required to enable Cookies in order to use certain aspects of CIY's sites. CIY may, at its option, make use of Cookie data in conjunction with third-party services to analyze browsing patterns and trends. In this use, your personal information will not be identifiable.

Legal Disclosure of Information

CIY will, as required by a lawful action, comply with subpoenas, warrants, or other court actions requiring it to disclose information collected on any of its websites.

Security / Encryption

CIY will use SSL – or other types of encryption that we deem appropriate, during any collection of protected, sensitive, secure information – specifically during financial transactions and/or during submission of medical release form data. You are advised that no form of encryption or security can provide 100% protection from unauthorized access to data. While CIY cannot fully guarantee the security of your information, we will take efforts to comply with legal standards and current commercial best practices.

Legal Jurisdiction

This policy is written and established in Jasper County, Missouri. This policy shall be interpreted according to the laws of the State of Missouri. Any legal proceeding pertaining to this policy shall be brought in the State courts of Jasper County, Missouri or the United States District Court for the Western District of Missouri.

SMS and Texting

By using Christ in Youth's services, including signing up for text message communications, you expressly consent to collecting, using, and sharing your personal information as outlined in our Privacy Policy. You acknowledge that you have read, understood, and agree to our Terms of Service and Privacy Policy, including the terms related to data collection, communication, and security. You further consent to receive text messages from Christ in Youth, including transactional and promotional messages. You may opt out of receiving promotional messages at any time by following the opt-out instructions provided in the messages, or by following the opt-out instructions below. Your continued use of our services constitutes your ongoing consent to these terms.

Opt-out Procedures

You may choose to stop receiving promotional text messages from Christ in Youth at any time. To opt out, simply reply to any text message you receive from us with the word 'STOP' or 'UNSUBSCRIBE.' Once we receive your opt-out request, we will promptly remove your number from our promotional messaging list. Please note that opting out of promotional messages will not affect your ability to receive important service-related communications.

Message Frequency and Content

By subscribing to Christ in Youth's text messaging service, you agree to receive transactional, or informational messages related to event details needed to carry out services for your organization and event attendees. You can expect to receive 10 to 30 messages per day depending on your specific situation. Message and data rates may apply. These messages are transactional and are necessary in order to communicate event details with your group. You also agree to receive Promotional messages from which you can expect to receive up to 5 messages per month and can be opted-out of at any time by following our opt out procedures.

Liability and Disclaimers

Christ in Youth is not responsible for any delays, failures in delivery, or any other issues related to the transmission or receipt of text messages. Delivery of text messages is subject to effective transmission by your mobile carrier and is not guaranteed by Christ in Youth. By subscribing to our SMS services, you acknowledge and agree that Christ in Youth will not be liable for any damages, losses, or injuries arising from or related to the use or failure to receive any text messages, including but not limited to, delays, non-delivery, or technical issues. Your use of our SMS services is at your own risk, and we provide our services on an 'as-is' basis without any warranties of any kind, express or implied.

Data Security and Information Handling

Christ in Youth is committed to protecting the security of your personal information. We implement industry-standard security measures to safeguard your data against unauthorized access, use, or disclosure. However, it is also your responsibility to protect the confidentiality of your account information and any passwords associated with your use of our services. You agree to notify Christ in Youth immediately of any unauthorized use of your account or any other security breach. Christ in Youth will not be liable for any loss or damage arising from your failure to protect your account or personal information adequately. By using our services, you acknowledge and accept that no data transmission over the Internet or mobile networks can be guaranteed to be 100% secure, and therefore, you use our services at your own risk.
